Speech Buddy (the “App”) is provided by Noetirex (“we”, “us”). By creating an account or using the App, you confirm that you are an adult (18 or older), that you accept these Terms of Use and the Privacy Policy, and that you are the parent or legal guardian of any child who uses the App under your supervision. If you do not agree, do not use the App.
Speech Buddy is an educational practice tool that presents words, sentences, pictures, audio, and simple games and activities for speech and language practice. It is not a medical device, does not provide medical advice, diagnosis, therapy, or treatment, and is not a substitute for evaluation or care by qualified professionals such as speech-language pathologists, pediatricians, or therapists. Always seek the advice of qualified professionals with any questions about a child's speech, development, or health, and never delay seeking professional care because of anything in the App.
We make no promises or guarantees about learning outcomes, progress, or improvement in speech or communication from using the App. Every child is different; results vary and may not occur.
The App is intended to be set up by an adult and used by children only with adult supervision. You are responsible for supervising any child's use of the App and for judging whether its content and audio are appropriate for your child, including volume levels and screen time.
You may sign in with a Google account, an Apple account, or a demo profile. You are responsible for the accuracy of the information you provide and for keeping access to your device and account secure. You may delete your account and all associated data at any time from inside the App.
You agree not to misuse the App, including attempting to reverse engineer it except where the law permits, interfering with its operation, or using it in any unlawful way.
The App, including its design, text, and lesson content, is owned by us or our licensors and is protected by copyright and other laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY EXCLUSIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE APP. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM (OR TEN U.S. DOLLARS IF YOU PAID NOTHING). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
You agree to indemnify and hold us harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms or your misuse of the App, to the extent permitted by law.
We may update the App and these Terms from time to time. Material changes will be presented in the App, and continued use after changes take effect constitutes acceptance. We may suspend or end availability of the App at any time. You may stop using the App at any time; Sections 7–12 survive termination.
